Data Processing Addendum

This addendum is part of our Terms of Service. It applies when you put a ClearMakes Agents agent on your website, or otherwise let other people talk to it, and we handle their personal data for you.

Who decides, who helps

You decide what your agent collects from your visitors and why: you are the controller. We are your processor: we handle your visitors’ data only on your behalf, only to run your agent, and only as your settings and these terms say. We do not use it for anything else and we do not sell it.

What data

What visitors type or upload, the address and title of the page they chat from, and, if location is on for the agent, their IP address and approximate city. It is kept for as long as your workspace keeps it.

Confidentiality

Only people who need to see this data to run or support the service can see it, and they must keep it confidential.

Security

We protect the data as described on our Security page.

Other companies we use

We use the companies on our sub-processors page, each bound to protect the data. Before we add or replace one, we update that page and tell workspace admins by email at least 14 days ahead, so you can object.

Helping you with requests

If one of your visitors asks to see, correct or delete their data, we help you do it. You can delete conversations yourself in the dashboard, or write to support@clearmakes.com. If a visitor writes to us directly, we pass the request on to you.

A security incident

If your visitors’ data is lost, stolen or seen by someone who should not see it, we tell you without undue delay, say what happened, and help you deal with it.

When you leave

When your workspace is deleted, we delete this data. Copies in our backups are removed as the backups roll over, within 30 days. We keep only what the law makes us keep, such as invoices.

Moving data between countries

We store the data in the United States. Where the law requires it for data from the UK, the EU or Switzerland, the standard contractual clauses approved for such transfers apply between you and us.
