Terms of Service

These terms cover your use of ClearMakes Agents, a service run by ClearMakes (“we”, “us”). By creating an account or using ClearMakes Agents you agree to them. If you use ClearMakes Agents for a company, you agree on its behalf.

Your account

Keep your password safe and your details accurate. You are responsible for what happens under your account and for the people you invite to your workspace. You must be at least 16 years old to use ClearMakes Agents.

Plans and payment

ClearMakes Agents has a free plan and paid plans billed monthly or yearly. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Prices are shown before you pay; taxes are added at checkout where they apply.

Paid plans renew automatically until you cancel. You can cancel at any time from Subscription → Billing; your plan stays active until the end of the period you have paid for, then your workspace moves to the free plan. Nothing you have created is deleted when you downgrade.

If you move to a different paid plan, the change happens straight away and the price is adjusted for the time left in your billing period (prorated): you pay the difference now, or get credit for it. We will tell you before we change our prices, and a new price applies only from your next renewal after that notice.

Ask within 14 days of any payment, including renewals and yearly payments, and we refund that payment in full. See our Refund Policy.

Usage limits

Each plan includes a number of agents, conversations per month, team members, documents and document space per agent, as shown on the pricing page. A Precise answer counts as 5 conversations. When a workspace reaches its monthly conversation limit, its agents keep answering a little longer (up to 10% more); after that, conversations already open carry on, and new ones wait until the next month or until you upgrade.

To keep things fair, one conversation can have up to 20 AI replies on the Free plan and 50 on paid plans (Enterprise limits are agreed with you). After that, the visitor can start a new conversation, which counts as another conversation.

If a paid plan ends (you cancel, or a payment still fails after Paddle’s retries), the workspace moves to the Free plan at the end of the time you paid for. Nothing is deleted: your agents, documents and conversations are kept. Agents beyond the Free plan’s number are paused, and features Free doesn’t include switch off, until you upgrade again.

Invite a friend

  • Every workspace has an invite link (Subscription page). When someone signs up for ClearMakes Agents through your link and pays for a plan, you each get one free month.
  • A friend counts once, if their workspace is new (made through your link) and they pay within 60 days.
  • We add the free months 14 days after your friend’s first payment, if it wasn’t refunded and their plan is still on.
  • A free month means your next payment moves one month later, with nothing charged for that month. It works the same on monthly and yearly plans. It has no cash value and can’t be exchanged or given to someone else.
  • On the Free plan, or on a plan that can’t take it right now (being cancelled, or a payment failing)? Your month waits and is added once you have a paid plan.
  • Enterprise plans agreed with us don’t get free months. A friend on one still counts for you.
  • You can earn up to 3 free months a month and 12 a year. Your friends still get theirs after that.
  • Not allowed: inviting yourself (another account, another email or the same card), fake accounts, sending your link to people who didn’t ask for it, or paid ads using our name. We don’t give, or we take back, months gained this way.
  • We never show you who your friends are, only how many joined.
  • We may change or end this offer. We’ll say so on this page first, and months you have already earned are kept.

Your content

You keep ownership of everything you upload and of your agents’ conversations. You give us permission to store and process that content only to run ClearMakes Agents for you. You must have the right to use the content you upload and must not use ClearMakes Agents for anything unlawful, harmful or abusive, or to send spam.

Acceptable use

You must not use ClearMakes Agents to:

  • send spam or messages people did not ask for;
  • pretend that an AI agent is a human being;
  • make automated decisions with serious effects on people, such as about jobs, credit, housing, insurance, health or legal matters, without a person checking them;
  • create, store or share illegal content, or content that harms or harasses others;
  • break the terms of apps you connect (such as Gmail, Slack or Google Drive).

Agents on your website

If you put an agent on your website, or share it with other people, you must tell them in your own privacy notice that you use ClearMakes Agents, what it collects, and that they are talking to an AI. For your visitors’ data you are the controller and we are your processor: our Data Processing Addendum applies and is part of these terms.

AI answers

The agents write answers with AI. Answers can be wrong or incomplete; check anything important before you rely on it, and do not use ClearMakes Agents as your only source for medical, legal or financial decisions.

Availability and changes

We work to keep ClearMakes Agents running but do not promise it will always be available or error-free. We may change features or these terms; if a change is significant we will tell you before it takes effect.

Liability

To the extent the law allows, ClearMakes Agents is provided “as is”, and our total liability to you for any claim is limited to the amount you paid us in the twelve months before it arose.

Ending

You can stop using ClearMakes Agents at any time. We may suspend accounts that break these terms. Ask us and we will delete your workspace and its content.
